MAYORAL RESOLUTION NO. 153-2019-MDS
Socabaya, June 27, 2019
HAVING SEEN:
Report No. 064-2019-MDS-A-GM-GGAYSP issued by the Management of Environmental Management and Public Services; and,
CONSIDERING:
That, Article 194 of the Political Constitution of the State, in accordance with Article II of the Preliminary Title of the Organic Law of Municipalities No. 27972, establishes that local governments enjoy political, economic, and administrative autonomy in matters within their competence.
That, Article 43 of Law No. 27972 – Organic Law of Municipalities prescribes that Mayoral Resolutions approve and resolve administrative matters; likewise, acts of recognition and commendation constitute evaluative and discretionary acts of the highest authority, such that recognition and commendation constitute the action of distinguishing and highlighting specific actions.
That Article 82 of Law No. 27972 – Organic Law of Municipalities establishes that municipalities, in matters of education, culture, sports, and recreation, have the following specific core competencies and functions shared with the national and regional governments: 16) To promote a civic culture of respect for community property, maintenance, cleaning, and the preservation and improvement of local town embellishment.
That through Report No. 064-2019-MDS-A-GM-GGAYSP, the Management of Environmental Management and Public Services states that on June 26, 2019, a cleaning campaign was carried out through various streets of the Bellapampa Sector, with the participation of the municipality’s workforce and the selfless support of the WeLoveU International Foundation, where 100 volunteers joined the commune staff to remove soil from the roads and reduce the dust produced by the works being carried out by the SEDAPAR Company; the said day of service took place on Junín, Francisco Bolognesi, Chimú, Leoncio Prado, Sucre, and América streets, among others; and since the district has benefited from the support of the aforementioned foundation and will also have it in the future with cleaning in different areas, housing associations, young towns (pueblos jóvenes), and human settlements of the Socabaya district, it is suggested to issue a Mayoral Resolution of recognition for this cause for the benefit of the residents and/or inhabitants of the Bellapampa community.
That, it is the policy of the District Municipality of Socabaya to recognize and value the performance and work of institutions that provide their services in a selfless and meritorious manner in favor of the community, whereby it is noted that the WeLoveU International Foundation has performed an outstanding service in the Bellapampa Sector, which must be recognized in order to be taken as an example to follow by other institutions operating within the district of Socabaya.
That Article 20, numeral 6 of the aforementioned Organic Law prescribes that it is the power of the Mayor to dictate Decrees and Mayoral Resolutions, subject to laws and ordinances.
In accordance with the faculties conferred by the Political Constitution of Peru, Law No. 27972 – Organic Law of Municipalities, and the considering clauses of this document.
IT IS RESOLVED:
ARTICLE FIRST: TO RECOGNIZE AND COMMEND the WELOVEU INTERNATIONAL FOUNDATION for its meritorious and selfless support in the Cleaning Campaign carried out on June 26, 2019, in the Bellapampa Sector, consisting of the removal of soil from the roads and the reduction of dust produced by the works being carried out by SEDAPAR on Junín, Francisco Bolognesi, Chimú, Leoncio Prado, Sucre, and América streets, among others.
ARTICLE SECOND: TO ENTRUST the Management of Environmental Management and Public Services with the strict compliance of this Mayoral Resolution.
ARTICLE THIRD: TO ORDER that the Municipal Management and the Management of Environmental Management and Public Services be informed of the content of this Mayoral Resolution, and that the Information Technology Unit publish it on the Institutional Portal.
ARTICLE FOURTH: TO ORDER the notification of this Mayoral Resolution to the representative of the WeLoveU International Foundation for the relevant purposes.

Examined:

Report No. 0058-2018-MDSL / SG-SGIIPV dated July 24, 2018, on the “Recognition of Merit to the INTERNATIONAL WeLoveU FOUNDATION,” and;

Considering:

That, Article 194 of the Political Constitution of Peru, modified by Law No. 28607 Constitutional Reform, states that the provincial and district municipalities are organs of Local Government and legal people of public law with political autonomy.

That, Article IV of the Preliminary Title of the Organic Law of Municipalities- Law No. 27972, prescribes that (. . .) local governments represent the neighborhood, promote the adequate provision of local public services and the integral sustainable and harmonious development of their constituency.

That, through the report No. 0058-2018-MDSL / SG-SGIIPV the Sub-Department of Institutional Image and Neighborhood Participation requested that the WeLoveU INTERNATIONAL FOUNDATION represented by its Chairwoman, Zahng Gil-jah be granted the Merit of Recognition.

That, the San Luis City Council approved the Regulations for the granting of decorations and distinctions of the District Municipality of San Luis by Municipal Ordinance No. 236-2017 No. MDSL/ C. Also, the Article no.07 of the aforementioned Regulation determines that (. . .) The Merit Recognition is a distinction that is granted to congratulate the neighbors and friends of the San Luis district, for their outstanding work and as deserves for the services provided for the benefit of the city. Likewise, Article no.08 of the bounded standard warns that (. . .) In the case of Merit Recognition, they will be granted by the Mayor through Resolution of the Head of the District

That, it is the policy of the current administration to grant recognition to the merit in favor of the WeLoveU INTERNATIONAL FOUNDATION represented by its Chairwoman, Zahng Gil-jah, for the selfless work she carries out through various professional social welfare services, in search of the fight against climate change in order to improve the welfare of the humanity worldwide.

Being subject to the above and according to the 6th clause of Article 20 and considering Article 43 of the Law No. 27972 – the Organic of Municipality, it;

Resolves:

First article: to grant recognition to the merit in favor of the INTERNATIONAL WeLoveU FOUNDATION represented by its Chairwoman, Zahng Gil-jah for the selfless work she carries out through professional social welfare services, in search of the fight against climate change in order to improve the welfare of humanity worldwide.

Second article: to instruct the General Secretariat to notify this Resolution, and to the Sub-Office of Institutional Image and Neighborhood Participation, its dissemination.

Preamble:
In accordance with the Article 194 of the Political Constitution of Peru, and Article 2 of the preamble of the Organization Act of Municipalities, local governments possess political, economic, and administrative autonomy within their jurisdictions. The right to autonomy, established by the Magna Carta for local governments, enables them to exercise public, administrative, and sovereign power subject to the legal system.

The official document No. 076-2017-MDK-GSPyGA/G/VEAR submitted by Public Service Environmental Management Director requests the official expression of gratitude to the Intl. WeLoveU Foundation led by the Chairwoman Zahng Gil-jah for cleaning Pastorita Huaracina Boulevard and carrying out the Rotary Painting Campaign through its Worldwide Clean WORLD Movement 2017 as part of the environmental project for the community on May 22.

Such activities raise social consciousness and inspire a sense of solidarity. They are appreciated as the pride of District of Independencia and deserve to receive the official expression of gratitude by the request of Public Service Environmental Management Director.

I perform the authority, approved by General Secretary, Legal Adviser, Public Service Environmental Management Director, and District Mayor, and based on the Organization Act of Municipalities Article 20, Paragraph 6, Item 27972, and Article 43.

Resolutions:
Article 1: The district of Independencia in the province of Huaraz officially expresses its appreciation to Zahng Gil-jah, the Chairwoman of the Intl. WeLoveU Foundation, which raised social consciousness and inspired a sense of solidarity by cleaning up the street of Pastorita Huaracina and holding the rotary painting campaign as part of the Clean WORLD Movement 2017 on May 22, 2017, and recognizes it as the exemplary organization.
Article 2: The district of Independencia conveys its gratitude to Zahng Gil-jah the Chairwoman of the Intl. WeLoveU Foundation.
Article 3: The district of Independencia praises the Intl. WeLoveU Foundation for carrying out social welfare activities and supporting financially by cleaning the street of Pastorita Huaracina and holding the rotary painting campaign.
Article 4: I deliver the resolution to the Public Service Environmental Management Director and entrust him with the duty of granting it to the Intl. WeLoveU Foundation.
